The legally organized society – the State – constitutes the largest public company in the country, regulated by the Constitution and the laws, and is governed by legitimate authorities elected by the people.
It would be ideal for the constitutional and legal precepts to be executed and the authorities to assume those responsibilities, especially with regard to the prescribed rights and guarantees and the correlative obligations. There are no complete studies on these topics, but there are partial or specific ones that are based on reports, of which the public knows little or nothing.
This situation – it must be recognized – is not recent. The bankruptcy of numerous public companies of the Ecuadorian State is real, and updates the debate on the role of the public sector in relation to services and citizen demands, in accordance with the letter and spirit of the laws, and something worrying: non-compliance of public policies aimed at protecting the income and expenditure of the public sector.
But if blind statism, lack of transparency and poor preparation of state executives prevail, the doors of corruption will be open and, of course, losses for the national treasury and for the citizens who pay taxes.
It is worth mentioning that sensitive aspects such as foreign debt negotiations, oil contracts, social security, the influence of drug trafficking and national defense are subject to the laws, but also to civil, administrative and criminal responsibilities of state executives, which They must make their decisions transparent.
The efficiency of the State must be measured with processes, results and evidence. It has been said that electronic government is an effective tool, among others, but if the management of state resources – which are foreign resources – is not carried out ethically, the efficient State will be a myth. The secret to the success of public companies lies in managing them with constitutional, legal and ethical criteria, privileging technical levels, minimizing the power of politicians and rewarding good results.
