Moses Katumbi
The Constitutional Court of the Democratic Republic of Congo met this Monday to rule on Noël Tshiani’s petition against the candidacy of Moïse Katumbi in the presidential election scheduled for December 2023. The Court declared this petition “admissible but unfounded “.
Noël Tshiani had raised concerns regarding the nationality of Moïse Katumbi, affirming that the latter held a nationality other than Congolese at the time he obtained his nationality certificate.
To support his position, Tshiani cited previous incidents where Moïse Katumbi allegedly used foreign passports to travel to other countries, notably when his Congolese passport was confiscated in 2017.
However, Moïse Katumbi’s lawyers argued in favor of the inadmissibility of the action, arguing that the question of nationality did not fall within the jurisdiction of the Constitutional Court in the context of the electoral dispute. They also underlined that the deadline for this request was exceeded and that there was a lack of interest, because Tshiani had not been the subject of a decision of invalidation from the Independent National Electoral Commission (CENI) which would justify his interest in contesting Katumbi’s candidacy.
Moïse Katumbi’s lawyers also challenged the use of evidence of public knowledge to support Tshiani’s request, saying that the certificate of nationality was the only legal document to prove Congolese nationality, a document that Katumbi holds.
The Constitutional Court ruled in favor of Moïse Katumbi, declaring Noël Tshiani’s request “admissible but unfounded”.
There was also a petition filed by a certain Tshivuadi Mansanoa. The author of this request raised questions concerning, according to him, a professional dispute which would involve candidate Katumbi. This request was declared inadmissible.
