UGT and CC OO have decided to follow in Iberia’s footsteps and challenge the ground services tender – “handling” – that Aena resolved on September 26. To this end, both unions have filed a claim with the Central Administrative Court of Contractual Resources requesting the annulment of the process and access to all documentation.

In a joint note, the two main unions reiterate that, in recent weeks, they had expressed their “uncertainties” about whether the process and award of the handling tender was capable of guaranteeing strict compliance with the labor obligations derived from the agreement. sectorial. CC OO and UGT assure that during the validity of the current licenses “there have been countless non-compliance by different operators in the social field.” In this regard, they add that although Aena has assured them in different communications of its intention to withdraw the licenses of those companies that commit non-compliance, “the truth is that this has never happened in recent years.” Furthermore, they assure that the tender specifications did not include a clear mechanism to act in these cases and the airport manager refused to accept a tripartite table during the allegations period.

UGT and CC OO have held two meetings with Aena management to address the issue and the conclusion they have drawn from both is that “it is impossible for us to verify that the guarantees we demand have been taken into account in the bidders’ offers. “.

All of this has led them to present the appeal, which if admitted, according to the unions, should result in the suspension of the awards until the court rules.

The unions had already revolted against the result of the contest, calling for protests against Aena, which they accuse of making employment at airports precarious. The centers also accused the airport manager of handing over a good part of the “handling” that Iberia had always done to “operators with a majority of foreign capital and some well-known in the sector for repeated non-compliance in labor matters.”

The majority unions in the sector follow in the footsteps of Iberia with this movement. The airline also presented another claim before the same court on October 20, considering that there were “irregularities” in the contest in which it lost eight licenses, including those of large airports.

The company justified this claim by arguing that the legal procedure for processing the file has been violated, which leaves it defenseless.

Along these lines, the airline maintains that the resolution has not been argued in any way and that in addition, confidentiality has been alleged to deny Iberia access to “sufficient information” in order to know the motivations for said scores. They also affirm that “the legal deadlines for the delivery of the file have been breached.”

Transparent contest

Faced with all this cataract of accusations, the airport manager counters that all companies that operate in their airports must comply with sectoral agreements in the subrogation processes and in the maintenance of the working conditions and salaries of the workers. Furthermore, he recalls that the public tender for assigning licenses for ground handling services is “economically neutral” for the manager.

Aena also states that the handling sector agreement specifically guarantees that “no worker loses their job and that everyone maintains their working and salary conditions.” Aena reiterates that “compliance with this agreement is mandatory.”

The manager explains that the result of the allocation of handling licenses is the result of a “transparent and objective” public tender, which emanates from a European directive and for which Aena is responsible because the legislation delegates a public function to it.
