The Senate reinforced, Thursday, November 9, the possibilities of expulsion of foreigners “delinquents” or not respecting the “principles of the Republic”, as part of the examination of the “immigration” bill. Presented as the right leg of the text, ardently defended by the Minister of the Interior Gérald Darmanin, an arsenal of measures was adopted. It was even strengthened by amendments from the senatorial majority (made up of the right and the center) and the government, a month almost to the day after the attack in Arras, on October 13, during which a French teacher was killed by a young radicalized Russian. The bill intends to lift the protections against expulsion that parents of French children, spouses of French people and foreigners in France have enjoyed for ten years. They can only be deported in the event of an attack on state security, if they have been sentenced to five years in prison or if they are polygamous. The Senate wants to make them deportable if they have been convicted of acts punishable by three years or more in prison or if they have committed domestic violence.

Foreigners who arrived in France before the age of 13, those residing in the country for more than twenty years or those who arrived for more than ten years and who are parents of French people or spouses of French people benefit from almost absolute protection. Except in the case of behavior that “undermining the fundamental interests of the State, or linked to activities of a terrorist nature, or constituting acts of explicit and deliberate provocation to discrimination, hatred or violence”. The Senate voted on Thursday for the possibility of expelling them in the event of “deliberate and particularly serious violation of the principles of the Republic” or in case of “final conviction for crimes or misdemeanors punishable by five years or more of imprisonment or three years on repeat”.

“Double punishment”

“Five years is theft with an aggravating circumstance and three years is simple theft”illustrated Mr. Bonnecarrère to demonstrate to what extent “we are lowering the level of protection”. “It’s the return of double punishment for foreigners”, regretted Senator Europe Ecologie-Les Verts des Bouches-du-Rhône Guy Benarroche. Retaining the criterion of the prison sentence incurred and not pronounced is also “disproportionate” in relation to the imperative of preserving private and family life. In 2021, 451 foreigners were convicted of a crime but if the new regime is definitively adopted, expulsion orders could apply to “nearly 99% of foreigners convicted [et] who are for crimes »fears Mr. Benarroche. “We are the only country in the entire EU [Union européenne] to have put on these protections »defended Mr. Darmanin, who estimates he can remove 4,000 more foreigners per year.
