On the 3rd anniversary of the Great Victory, with the decrees of the President dated November 7, 2023, the official salaries of the military personnel of the Azerbaijan Armed Forces were increased by 20 percent. It is gratifying, it is the halal right of our soldiers. On the one hand, it is at least incomprehensible that the decree should not be applied to military service veterans – disabled, martyrs from this year on the basis of an absurd decision – disabled and martyrs do not pay compulsory insurance premiums to the state. Look at the absurdity, the state demands a compulsory insurance fee – “blood tax” from a veteran who was retired due to disability from military service, from a martyr who sacrificed his life for the state! (?) Should the state pay “blood money” to the martyr, or should the martyr pay to the state? The martyr gave his blood to the state, and now they take the money for this blood from the martyr and his pension? Such a social policy?
According to Article 29.2 of the Law “On Labor Pensions” dated 06.02.2006, when the salary-security expenses of veterans, disabled, and martyrs are increased for the positions they hold in the service, their pensions are recalculated according to this increase. Since this article was canceled on the 2nd anniversary of the Great Victory – 05.11.2022, the increase in the provision of servicemen’s expenses does not lead to an increase in the pensions of war disabled people and families of martyrs. The “legal basis” of this “attention and care” for the families of veterans and martyrs is the Decision of the Plenum of the Constitutional Court (KM) dated 15.05.2020 at the request of the Cabinet of Ministers. The “social government” requested the interpretation of the “subsequent increases” highlighted in parentheses in Article 1 of the Law “On Labor Pensions”, and the Plenum, in accordance with the request of the NK, agreed to increase the pensions of military personnel and veterans to the principle of social protection, insurance – insurance premium. – considered it against receiving “ganpulu” – insurance payment without paying “blood tax”. It is true that the mentioned decision of the KM Plenum talks about pensioners based on Article 20.14 of the Law “On Labor Pensions”, i.e. retired military personnel according to age, but the amendment to the Law “On Labor Pensions” dated 05.11.2022 also includes the families of disabled and martyrs. attention and care” he did not neglect. The phrase “subsequent increments” in the law has been replaced by “increments up to the date of retirement”, and Article 29.2 has been repealed. Look at the “attention and care” of the state, until you become a disabled person, a martyr – what you received until you retire, stay away from further increases. Why? Mandatory insurance premiums are not paid to the state! (?) Isn’t the state the insurer of military personnel? Does not applying this article to disabled military servicemen and martyrs, whose average number is around 30-40,000, harm the state?
It is the 3rd anniversary of the Great Victory. In connection with this great holiday, the government is planting trees somewhere, building houses somewhere… The head of state is increasing the security of the Armed Forces, of which he is the Commander-in-Chief. Veterans-martyrs have not received anything from this provision for three years. (Since the law dated 05.11.2022 is retroactively applied to the act of the President dated 23.12.2021 dated 23.12.2021 contrary to the Constitution, the age of lack of security is three years).
In our opinion, the state (authority) should consider the restoration of Article 29.2 of the Law on Labor Pensions, which was repealed by the law dated 05.11.2022, regarding veterans and martyrs. At least, the 120 deputies of the Milli Majlis can’t think about the impossibility of the martyr paying the compulsory insurance fee to the state, as they say, blood tax?
It is necessary to think, why the income and livelihood of the martyrs comes only from their blood. Is it appropriate for GAZI STATE to claim the blood of the holy martyr?
