The prosecution requests up to 27 years in prison for 12 CDR that the PSOE includes in the amnesty law

The Prosecutor’s Office of the National Court has requested prison for 12 members of the Committees for the Defense of the Republic (CDR) for a crime of belonging to a terrorist organization. The members are the same that the Socialist Party includes in its amnesty law.

Prosecutor Miguel Ángel Carballo assures in the indictment that these individuals were part of a Tactical Response Team. This is a group formed by different members of the CDR who came to form a parallel terrorist organization in a clandestine manner. Their objective was to carry out violent actions or attacks with incendiary substances.

They might not be amnestied

The 12 CDR that prosecutor Carballo asks to go to prison were key to the negotiation on the amnesty law between the PSOE and the pro-independence parties due to the accusation of terrorist organization crimes. The law, already registered in Congress, excludes all those who have carried out “acts classified as terrorist crimes punishable in Chapter VII of Title XXII of the Penal Code as long as a final sentence has been handed down.”

The indictment is signed by the same prosecutor who has already ruled out the crime of terrorism in the investigation into the Tsunami Democràtic group, in which the fugitives Puigdemont and the general secretary of ERC, Marta Rovira, are accused. In this procedure, the prosecutor considered that the evidence collected did not support the existence of a criminal organization or group, nor its terrorist nature.

The accusation of terrorism is a circumstance that can be key in the future of the accused, because a conviction for terrorism would mean that they would not be able to benefit from the amnesty.

Carballo requests 27 years in prison for Eduardo Garzón, Queralt Casoliva, Jordi Ros, Alexis Codina, Rafael Delgado, Sonia Pascual, Germinal Tomás and Esther García. All of them are accused of crimes of belonging to a terrorist organization, possession, storage or manufacture of explosives and attempted damage. Not only does he believe that they should go to jail, but also the Public Ministry requests the measure of supervised release for eight years.

“The classic pro-independence organizations were joined by a new actor who called himself the CDR. The CDR’s activity contributed great dynamism to the street mobilization, being key to the planning and execution of simple actions (graffiti) and complex actions (general strikes, country courts, etc.)”, reads the statement.

The document states that the accused presented “great radicalism” and their plans were based on unsuccessfully occupying the Parliament of Catalonia coinciding with the second anniversary of 1-O. All this, “under an estimated budget of 6,000 euros.”
