Pensions and aid: Can I collect them if I live abroad?

The public benefits of a country protect the citizens who reside there. But what happens when a pensioner, an unemployed person or a recipient of some type of benefit or subsidy moves to live abroad? Do you lose the right to collect them? It all depends on the type of benefit and the time spent outside of Spain.

In the case of Social Security contributory pensions – retirement, permanent disability, widowhood, orphanhood and for family members – they are generally compatible with international travel or changes of address.

However, when the recipient is collecting a complement to minimums -amount that completes a contributory pension that does not reach the legally established minimum-, you will no longer be able to perceive itsince “Social Security establishes that it is an essential requirement to reside in Spanish territory,” explains Jorge Campmany, from the Campmany Abogados law firm.

There are also nuances in collecting a disability pension abroad. Specifically, when the benefit is for permanent disability and the beneficiary is 55 years old or older. If that person had requested total qualified disability because they were not working and, consequently, their pension was no longer 55% of the regulatory base, but 75%, “that added 20% is lost if they stop living in Spain.” », adds the Campmany expert.

As for the retirement pension, it can also continue to be received in another country, except those of a partial, flexible and active nature, since the collection of the benefit is combined with work that necessarily has to be carried out in Spain. In order to collect your retirement abroad, you must notify the National Social Security Institute (INSS) of your change of residence.

Furthermore, pensioners residing outside of Spain have to prove to Social Security every year that they are still alive, to ensure that the benefit is not being collected by another person. If this procedure is not carried out, or is done after the deadline, the pensioner may lose his or her benefit.

For their part, non-contributory pensions – disability and retirement without a contributory level – can only be collected if you reside in the country.

Unemployment benefits and subsidies

In the case of contributory benefits and unemployment subsidies, there are different scenarios, which depend on the reason and duration of the move abroad. If it is for work reasons – working, looking for a job, studying to improve professional preparation, or for international cooperation actions – and lasts less than twelve continuous months, the benefit or subsidy is suspended. If it is for a longer period of time, it expires.

This period is six months for recipients of the Active Insertion Income (RAI) – collected by those without the right to contributory benefits or unemployment benefits – who go abroad for the same reason. In addition, it is mandatory to notify the transfer to the State Public Employment Service (SEPE).

When the recipient of a contributory benefit, unemployment benefit or RAI moves outside of Spain for any reason unrelated to work, if it does not exceed more than 15 calendar days – whether continuous or not – during each calendar year, they may continue to collect, after communication to SEPE.

If the trip lasts more than 15 days and up to 90, benefits are suspended. In the event that the transfer exceeds 90 days and is not motivated by work, they will be terminated.
