Law against unisex bathrooms in churches comes into force

Thinking about protecting religious freedom, a new law was sanctioned in Belo Horizonte, capital of Minas Gerais, by mayor Fuad Noman (PSD). The measure aims to prevent religious temples from being forced to use unisex bathrooms.

This is Law No. 11,610, of November 20, 2023. It guarantees “temples, confessional schools and institutions maintained by religious entities the attribution of the use of their bathrooms in accordance with the biological definition of sex.”

Law No. 11,610 originates from Bill No. 400/22, authored by councilor Flávia Borja. With the measure, religious institutions in Belo Horizonte or those managed by them, such as PUC Minas and Colégio Batista, cannot be forced to offer unisex bathrooms, remaining protected in this regard.

The new lei It is objective, being basically composed of two articles, plus a third that guides its applicability upon publication in the Official Gazette of the Municipality (DOM). The text says:

Art. 1 – Temples of any cult will be guaranteed the freedom to assign the use of the bathrooms on their premises according to the biological definition of sex, by the denomination “male” and “female”, and not by gender identity.

Art. 2 – The provisions of this law also apply to confessional schools and institutions maintained by religious entities, as well as to events and activities carried out by them, even if outside their premises.

For defenders of the measure, the law represents a mechanism to guarantee religious freedom in the face of the activism of the LGBT+ movement, which has been acting increasingly aggressively against critics.
