The APM, which closes its XXVI National Congress this Friday in Bilbao, has approved a declaration, “in defense of the rule of law”, in which it affirms that the proposed amnesty law violates the principle of equality and “seriously undermines” the principle of separation of powers.

The Professional Association of the Judiciary urges judicial renewal

The Professional Association of the Judiciary, within the framework of its XXVI National Congress, has issued a transcendental statement in defense of the Rule of Law. In this statement, several fundamental concerns and positions are addressed.

Firstly, there is a firm rejection of the approval of an amnesty law that, according to the APM, violates the principle of equality. It is argued that this measure lacks support in the context of a consolidated democratic regime like the Spanish one, even representing a disavowal of the constitutional position of the Judiciary, particularly the Supreme Court. Consequently, it is emphasized that the approval of said law would constitute a direct attack on the pillars of the Rule of Law.

Furthermore, the APM expresses a categorical rejection of the possibility of supervising the work of Judges and Courts through parliamentary investigation commissions. It is emphasized that these judicial actors carry out their work by applying the law and the law, in accordance with constitutional mandates, and, therefore, they should not be subject to this type of parliamentary scrutiny.

In relation to the election of the Members of judicial origin of the General Council of the Judiciary, the APM defends the election for the Judicial Career. However, despite this principle, the serious situation generated by the extension of a mandate that ended five years ago is recognized. Given this, an urgent call is made to the parliamentary groups for the prompt renewal of the Council. Furthermore, the adoption of legislative initiatives aligned with the recommendations of the European Union is suggested, with the aim of ensuring the recovery of the judicial executive system in the future.

Given the “serious situation and consequences that are dragging on” due to the extension of the mandate concluded five years ago in the General Council of the Judiciary, the APM makes an urgent call to the parliamentary groups to carry out the renewal of the CGPJ.

All this, “without prejudice to the promotion, in line with the recommendations of the European Union, of the appropriate legislative initiatives to achieve the recovery of the elective judicial system in the future”
