On December 16, 2022, Mrs. Béatrice Rosen filed a complaint with the courts against Dr. Marty following denigrating and defamatory comments made against him. She received justice on Monday, December 11, 2023.
Dr. Jérôme Marty suffered of a blame for breach of ethical obligations. This is reported in a press release from Me Thomas Bénage, counsel for Ms. Rosen, dated December 13, 2023. The disciplinary chamber of the Order of Physicians ruled that the ethical obligations are imposed on Dr. Marty under the provisions of article R4127-3 of the public health code following the defamatory statements made about Béatrice Rosen.
“It’s a major decisionbecause when Dr. Marty’s remarks were made, many media published articles without even deigning to call me, thus taking Dr. Marty’s side” Béatice Rosen told us. Before concluding : “I had requested rights of reply, in vain. This decision is therefore for me my right of response to the media which relayed the defamatory remarks of Dr. Marty.”
Me Bénages, joined today by France-Soir, specifies :
“Doctor Marty stated in his defense that he was not the author of the press release press release targeting Béatrice Rosen, arguing that this press release came from the board of directors of her union. The disciplinary chamber has categorically rejected this defense, considering that Jérôme Marty being the president of the union, he was responsible before the ordinary courts for the comments made.
He adds :
“The disciplinary chamber therefore emphasizes that one cannot hide behind a professional association to make defamatory remarks with complete impunity.” Maître Bénages emphasizes that it is “of a particularly severe sanction because the disciplinary chamber was not content to inflict a simple warning on Dr. Marty.”
Jérôme Marty, who is trying to establish himself as a new figure in medical unionism, does not hesitate to go beyond his ordinal duties “whatever it takes” to attract attention. He had been identified as one of the particularly obnoxious, vulgar, active and aggressive actors during our investigation into the harassphere (episode 1, episode 2, episode 3). Not having appropriate language for a doctor on social networks, he also does not hesitate to use fallacious pretexts before the ordinary court.
He is not close to an accusatory inversion, and he is not the last to engage in double talk. In addition, he is the author of an “antiscience” outburst which made the rounds on social networks, explaining about Covid vaccination on June 18, 2021 on the RMC antenna, during the show The Big Mouths: “We have more than a billion people who have been vaccinated, we have thousands of years of BACKGROUND (?) on this vaccine, in fact.”
This is not the first complaint filed against Dr. Marty which combines them, the latest being that of the Liberté Santé Union, for whom Jérôme Marty’s comments have “participated in the creation and maintenance of a climate of fear among the French, and thus vitiated their free and informed consent.”
Doctor Marty’s legal and ordinal horizon darkens. Has the time for a trend reversal finally arrived?
