How many days of paternity leave are given?

According to the Federal Labor Law In article 132, section XXVII bis, it was established that the employer’s obligation was to grant the male worker a paternity leave of 5 working days with pay.

However, during the assembly on Tuesday, December 12, the Chamber of Deputies of Mexico approved with 409 votes in favor the increase from 5 to 20 paid work days for paternity leave.

This extension applies to public and private sector workers; It also comes into force at the moment the minor arrives at home, whether by birth or through the adoption process.

When do the 20 days of paternity leave come into effect?

The extension of paternity leave applies to both public and private sector workers, and the leave applies in cases of birth but also adoption.

In this sense, the permits apply from the arrival of the minor at home, in addition to contemplating that, in the event that the mother has any complications, the permit can be extended to a maximum of 30 paid work days.

It is important to mention that the days of the permit do not include weekends, as they must be business days, and holidays do not count either.
