The European Union has launched an investigation into Elon Musk’s social media platform, X (formerly known as Twitter), focusing on the spread of illegal content. The investigation, announced Monday, is examining possible violations of the Digital Services Act, which aims to ensure online consumer safety.

The probe is specifically looking into how X handles illegal content such as hate speech, misinformation, and terrorist-related content in relation to the Israel-Gaza conflict. Additionally, the investigation will assess the adequacy of the platform’s fact-checking system, transparency mechanisms for advertisements, and the revamped verification system.

Margrethe Vestager, executive vice president of the European Commission, emphasized the importance of holding large platforms to specific standards due to the potential risks they pose to society.

The news of the investigation follows increased scrutiny of X over the spread of disinformation related to the Israel-Gaza conflict, with reports of a surge in instances of antisemitic content. The Anti-Defamation League reported a 900% increase in antisemitic content since the conflict escalated, and Musk has faced criticism for using his platform to elevate antisemitic theories.

This investigation represents the first formal proceeding against a large social media platform under the Digital Services Act, which came into force in November 2022. If found in violation of the act, X could face fines of up to 6% of its global revenue.

The European Commission, spearheaded by Commissioner Thierry Breton, has been proactive in its approach to regulating large online platforms. Breton previously issued a warning letter to Musk and has emphasized the need for platforms to adhere to the requirements laid out in the Digital Services Act.

X has stated that it is committed to complying with the Digital Services Act and is cooperating with the regulatory process. The company emphasized its focus on creating a safe and inclusive environment while protecting freedom of expression.

The next steps in the investigation may involve information requests, interviews, or inspections, but no formal deadline has been set for bringing the proceedings to an end.
