The Colorado Supreme Court issued a decision this Tuesday (19) disqualifying Donald Trump from holding the office of President of the United States.

This is the first time in history that Section 3 of the 14th Amendment to the US Constitution has been used to impede someone’s presidential candidacy.

The basis for this decision centers on Trump’s actions during the events of January 6, 2021, when the former president spoke and incited his followers to invade the Capitol in Washington DC This episode occurred after Trump’s defeat in the presidential elections for Joe Biden.

The Colorado Supreme Court based its decision on its interpretation of Section 3 of the 14th Amendment, which addresses issues related to insurrection or rebellion against the United States.

The majority of judges found that Trump’s actions during the Capitol episode disqualify him under the terms of that section.

That decision represented a reversal of an earlier ruling by a district judge, which concluded that although Trump had incited the insurrection, there were questions about whether the 14th Amendment provision applied specifically to the presidency.

The Colorado Supreme Court has suspended implementation of the ruling until January 4, or until the U.S. Supreme Court makes a final ruling on the case. This suggests a pause while they await a national-level resolution.

Donald Trump’s defense stated that it will immediately appeal any disqualification to the US Supreme Court.
