That bar built inside the Buondormire cave must be removed, together with the structures deemed illegal by the Municipality of Centola Palinuro. This is the sentence issued by the TAR judges Salerno who rejected the appeal presented by the lawyers of a well-known hotel in Palinuro which, within its property, has the characteristic beach, one of the pearls of Cilento. For the judges of Largo San Tommaso, in fact, from the documents attached to the file by the appellant company, «it cannot in any way be argued that the change in intended use of the cave in question was approved from a building, landscape, environmental and hydrogeological point of view, since the documentation attached to the appeal certifies nothing regarding the prior issuing of a building permit legitimizing the disputed change of use, nor as regards the prior acquisition of the opinions of the authorities responsible for protecting the constraints on the area (Basin Authority, Cilento Park Authority and Superintendence)».
The landscape constraint
In short, according to the TAR, «it is not in any way proven that the disputed change of destination occurred some time ago, under the previous management of the tourist complex, and prior to the restrictive legislation cited in the contested provision, which in any case constitutes the development and specification of the legal provisions with to which the natural and landscape beauties of the Palinuro district had already been subjected to environmental restrictions».
