Michael Brenner, holder of the chair for German and European constitutional and administrative law at the Friedrich Schiller University of Jena and a much sought-after expert, legal representative and expert, is now a volunteer member of a committee in connection with the elections for the sixth time The Bundestag and the European Parliament are of particular importance.
In connection with the European elections, the Federal Election Committee decides both on the approval of the parties’ election nomination lists for individual federal states and on the approval of joint lists for all federal states. In particular, he must check whether election proposals were submitted late or do not meet the legal requirements for other reasons.
The first meeting of the Federal Election Committee, which consists of the Federal Returning Officer, eight volunteer assessors and two judges of the Federal Administrative Court, takes place on the 72nd day before the election, i.e. on Good Friday. Complaints are admissible against the admission decisions of the Federal Election Committee, which the Federal Election Committee itself decides on. An appeal against its decisions can be lodged with the Federal Constitutional Court within four days.
So far, 121 parties and associations have submitted their documents to the Federal Returning Officer. Each of them must indicate by March 18th whether they actually want to take part in the election.
