Shira finished grueling reserve service and decided she deserved a little rest after the exhausting days she experienced. She purchased a vacation package abroad through a travel agency and paid all the money.

A few days later, she received a message from the company, informing her that the flight was postponed – and that the airline had set a new date for the destination. But the new date did not suit the singing due to work and previous commitments.

When she asked to receive the payment back, the company refused to return her money, shifted the responsibility from her onwards and claimed that the change was made due to the cancellation of the flights by the airline.

Attorney Hadas Jacobson, CEO of the new consumer association: “Shira’s claim is certainly justified. When we purchase a vacation package, an essential part of the transaction is the time it takes place.

Therefore, when a flight is canceled and does not allow us to go on vacation on the planned date, this is a fundamental change in the details of the transaction. In such a situation, the travel agency cannot “force” us to go on vacation on another date, and is obligated to return the funds.

Although, the agency is not the one responsible for the cancellation of the flight, therefore, Shira will not be able to demand compensation for the mental anguish, or any other damage caused to her due to the cancellation of the vacation, since the travel agency is not responsible for damages, but she is certainly entitled to demand her money back.

Adi moved to a rented apartment and purchased a roller blind for the window on the website. When the package arrived, she discovered that the curtain did not fit the size of the window. She contacted customer service and asked to cancel the transaction, and was told that since she had opened the package, there was no possibility of cancellation.

To know whether the consumer protection law allows Adi to cancel the transaction, one must first find out whether it is a catalog product selected from the website of the business (that is, a curtain that is offered in several sizes and from which Adi chose one option). In such a case, the provisions of Section 14 of the Consumer Protection Law allow the witness to cancel the transaction even if the product packaging has been opened.

“When you purchase a catalog product from a website, you have the right to cancel the transaction if you regret it or if the product does not suit your needs, even if the packaging has been opened and if an attempt has been made to use the product,” Yaakovson says.

“The business must return your money, minus a cancellation fee of 5% or NIS 100, whichever is lower. If the product is damaged, the business may demand a decrease in its value, but only after the money has been returned.
