Thiruvananthapuram: Opposition leader VD Satheesan has written another letter to the Governor condemning the arguments of the government in the Lokayukta Amendment Ordinance. The governor had sought an explanation from the government in a letter issued by the UDF delegation on January 27 asking that the ordinance be declared illegal and not be signed. The letter from the Leader of the Opposition said that the explanation given by the government was misleading.

The government’s argument that the courts do not have the power to direct a public servant to resign through a quo warranto writ is false. K.C. The government is making this argument citing the Chandy-R Balakrishna Pillai case. However, the Supreme Court of the country has ordered the resignation of the Chief Minister of Tamil Nadu through a quorum warrant in the BR Kapoor-State of Tamil Nadu (September 21, 2001) case.

The Supreme Court’s ruling that a public servant can be removed from office through a quo warranto writ applies to all other courts in the country. According to the government explanation, K.C. In the Chandy-R Balakrishna Pillai case, the Kerala High Court pointed out that the only limitation was the issuance of a quo warrant by a minister for breach of oath.

It is an anti-corruption body set up by a law passed by the Kerala Legislative Assembly. It is not within the purview of the Lokayukta to take action against a breach of oath. The Leader of the Opposition explained in the letter that KT Jalil was disqualified from continuing as a Minister under Section 14 of the Lokayukta Act and that he had abused his power to appoint a relative.

The Leader of the Opposition again requested the Governor not to sign the ordinance unless any of the explanations given by the government are backed by law.
