At 8:00 a.m. on February 18 in Galicia, the polling stations will begin to be set up. Just one hour before the doors open at the schools, those people who have been designated as president and members, both regular and alternate, will have to appear. Although it is true that when the starters appear, the substitutes can leave.

Each polling station is made up of a total of three members: a president and two members. These people are chosen by lot from all the people included in the list of voters of the corresponding table. For the Galicia elections, this draw took place between January 20 and 24, depending on each municipality.

The Organic Law of the General Electoral Regime (LOREG) indicates in its article 27 that “the positions of President and Member of the Electoral Tables are mandatory”, although it is true that there are a series of cases in which a person would be justified not to attend.

But if it is not for a justified and correctly proven reason, it is important to know that anyone who does not comply with their obligation faces a fine. The Police or Civil Guard can appear at the home of said person and the sanctions that can be imposed range from 6 to 24 months with amounts that, as a general rule, range from approximately 2,000 to 7,000 euros. And be careful because according to article 143 of the Organic Law of the General Electoral Regime, this absence can lead to prison sentences of between 3 months and one year.

And, how do you prove a reason for not attending the polling station on election day? Those appointed have 7 days from notification to present to the corresponding Zone Electoral Board a justified and documented cause that prevents them from accepting the position.

The Zonal Electoral Board has five days to resolve the allegations. There is no appeal against this resolution through administrative electoral channels, although there is any jurisdictional appeal that the interested party deems pertinent. Challenges will be processed through contentious-administrative channels.

What rights do board members have?

The Presidents and Members of the Boards, as well as the substitutes who are finally designated as regular members, will have:

  • A diet
  • Full-time paid leave on voting day, if it is a working day, and a reduction in your work day by five hours on the day immediately following
  • They will be protected by the Social Security system against contingencies and situations that may arise from their participation.
