European court of human rights

Thunderbolt at the European Court of Human Rights. The 47 judges representing the 47 member countries of the Council of Europe unanimously decided that there was no right to same-sex marriage.

This historic decision is based on Article 12 of the European Convention on Human Rights, as well as other international treaties. According to the magistrates, the traditional concept of marriage refers to the union between a man and a woman.

No obligation to open marriage to homosexuals

Governments therefore have no obligation to authorize same-sex marriage, the Court considers. Which also brushes aside the accusation of discrimination: reserving marriage for heterosexual couples cannot be considered discriminatory.

This judgment has already caused a lot of reaction due to its retrograde nature for associations defending homosexual rights. But the highest European court in matters of human rights seems to have settled, at least provisionally, this divisive social debate.
