Advertisements and other publications often use superlative adjectives (for example, “best”, “most affordable”, “biggest”, “highest quality”, etc.), as well as words emphasizing the advantage of business entities and their products (for example, “leading”, ” exclusive” etc.).

The Commission for the Protection of Competition informs that such formulations may lead to misleading the public or unfair competition by making inappropriate comparisons, if:

have no factual basis, i.e. do not correspond to reality,

have a factual basis, but an incorrect or inappropriate comparison has been made.

Emphasizing the prevention of violations, the Commission urges business operators to comply with the requirements of competition law and to refrain from such illegal behavior.

We remind you that the amount of the fine imposed for unfair competition is up to five percent of the income of the business entity in the year preceding the offense.
