Congress processes a law that seeks to remove the private sector from State entities

The initiative called “Law for the freedom of enterprises” that seeks to remove the private sector from the boards of directors of State entities was read in the plenary session of Congress and sent to the Economy and Small and Medium Enterprise commissions for the respective analysis.

It’s news. The proposal, presented on October 24, 2022, seeks that the Coordinating Committee of Agricultural, Commercial, Industrial and Financial Associations (Cacif) does not form part of the boards of directors of collegiate bodies that are related to state affairs.

  • Some of the entities where the private sector is represented are: National Mortgage Credit, the National Electric Energy Commission and the Land Fund.
  • Also the Monetary Board, Board of Directors of the Guatemalan Social Security Institute, among others.
  • It is proposed to make an election among the companies that register for a census, which will be coordinated by the Ministry of Economy (Mineco).

The data. The initiative, presented by Samuel Pérez and other Semilla deputies, will be analyzed and ruled on by the Small and Medium Enterprise Commission, chaired by Ernesto Bran of the Valor party.

  • The other commission that must issue an opinion is the Economy Commission, which has not yet been assigned, since the Semilla deputies were seeking to preside over it, as well as the Finance, Environment and Legislation Commission.
  • With the resolution of the CC, Congress must assign the four commissions within a period of no more than 8 days.

What to highlight. The reaction of the private sector when the initiative was presented was that congressmen are free to propose the bills they consider.

  • However, they recalled that the model has worked and its presence in the directives is not to obtain particular benefits but in favor of the country.
