Alas… The highest court of the Bled on Friday purely and simply rejected the appeal for annulment filed against his indictment by the pool of lawyers (without dressing) formed for his defense.

It thus confirms the decision of the 2e Chamber of control of the investigation of the Court of Appeal of Cona-crime, also orders the confiscation for the benefit of the public treasury of the deposit of 30,000 sliding francs deposited by the applicants. Welcome Lamah is therefore obliged to stay at the gnouf. Time for the dean of the investigating judges of the Dixinn court to finish the investigations and decide whether or not to refer him to the trial court.

The ruling of the Lower Supreme Court does not seem to surprise the defense. Even before the deliberations, one of Pandora’s lawyers muttered: “We already know the fate reserved for our client, we just come for formality.”

However, Me Zézé Kalivogui did not expect such a decision: “We are frustrated because we did not think that the combined Chambers could ratify such a procedure. » He is now counting on the investigation to demonstrate his client’s innocence: “This decision sends us back to the Dixinn court so that the investigation can resume on new charges. We are going to show that he has nothing to do with this matter. We have the weapons for this.” Ammunition, too?

Among the lawyers of the civil parties, it’s party time. “We are satisfied with the decision. We fought to put an end to impunity in this country, so that all those involved in this affair are judged…We have sufficiently demonstrated that there is reason to reject this appeal”, jubilant Me Bernard Saa Dissi Millimouno.

If Colonel Bienvenu Lamah is referred to the trial court, the civil parties intend to request a joinder of the proceedings with the current trial on the massacre of September 28, 2009. “In the interest of the procedure, and since it is acts on the same facts,” explains Me Millimouno.

Bienvenu Lamah was one of the leaders of the Kaléah (Forécariah) training camp at the time of the events in 2009. But he benefited from a dismissal of the case. Aboubacar Sidiki Diakité known as Toumba, one of the accused, denounced him during his testimony at the bar. Bienvenu was summoned, questioned, charged with “complicity in abuse of authority, murder, assassinations, rape and intentional bodily harm”, imprisoned at the five-star Hotel in Coronthie. One of the investigating chambers of the Court of Appeal annuls his indictment. The civil party appealed to the Court of Cassation and won the case. The case, taken up again, resulted in a new indictment. It was against this last decision that the defense lodged an appeal. Without success.
