The Ministry of Public Health (MSP) reported that it is working on the regulations that will regulate the procedure for the application of voluntary and voluntary active euthanasia. This follows the provision of the Constitutional Court (CC) through ruling 67-23-IN/24 of February 5, 2024.

Ecuador is the ninth country that approved euthanasia.

To prepare the regulations, a technical table was formed that will deliver the document within a period of two months, according to the procedure. The MSP affirms that it abides by the provisions and guarantees work in accordance with the country’s legal guidelines.

The decision of the Constitutional Court on the decriminalization of euthanasia is immediately applicable. This was maintained by the legal team of Paola Roldán, who proposed the legalization of assisted death in Ecuador.

The clarification arose in response to doubts about its execution, since the Court determined three aspects. First, the Ombudsman’s Office must deliver to the National Assembly, within a maximum period of six months, a draft law that regulates the application of euthanasia. Once the document is delivered, the Legislature has a maximum period of 12 months to know, discuss, and issue the law.

Meanwhile, the MSP has a maximum period of two months to issue a regulation that will regulate the application of voluntary and voluntary active euthanasia. This Secretary of State must send the Regulations to the Court to verify compliance and will be valid only until the approval of the respective law.

This, however, does not condition the decriminalization of euthanasia. Roldán’s lawyers: Farith Simon, Pablo Encalada and Ramiro Ávila, explained that this does not depend on the MSP regulations. “It is not conditioned,” they emphasized. /The Telegraph.
