Abu Dhabi: (www.kvartha.com 08.02.2022) Abu Dhabi revises foreign divorce terms This includes provisions for compensation for women who have to leave work to care for children. The provisions apply to non-Muslims and Muslims from non-Sharia countries. The most notable decision was the introduction of compensation for those who had to divorce and leave their jobs to care for children. This is the first time such a provision has been made for divorcees. Compensation is based on a number of factors, including the reasons for the divorce, social status, and financial benefits lost due to leaving the job.

Compensation for those who have to quit their high-paying jobs will also increase. The ex-husband’s current financial status, job security and the length of time he or she has been in the marriage are crucial in making a decision. Those who divorce after a long marriage will have to pay more. Until now, a court-determined portion of a husband’s salary or assets has been provided as compensation in a divorce.

Under the new law, foreign lawyers will be able to represent their parties in non-Muslim family courts. Until now, only indigenous lawyers were allowed. Apart from UAE nationals, Shariah applies only to Muslims from Saudi Arabia, Yemen, Egypt and Bahrain.

Yusuf Saeed Al Ibri, Undersecretary of the Law Department, said the changes were made in Article 52 of the Laws on Divorce, Joint Child Protection, Financial Involvement in Divorce, Parental Role and Adoption.

These reforms are based on the latest innovations and international practices. The law also allows for a lump sum payment of less than 25 per cent of the husband’s salary, multiplied by the number of years of marriage. Foreign lawyers are allowed to represent the parties in the Non-Muslim Family Court. Until now, only indigenous lawyers were allowed. After the divorce and the settlement of the dispute, the parents will automatically be given equal custody of the children. At the same time, the law of inheritance states that if a person dies without making a will, half of the property will go to the wife and the rest to the children. It’s part of making Abu Dhabi a better place to work and live for the global community through transparent legal frameworks.
