Lawyers responded to Bullrich | Criminal lawyers and the right of defense

Rosario’s criminal lawyers yesterday harshly criticized the Minister of National Security, Patricia Bullrich, for having attacked the right to defense of every person, during her visit to Rosario to announce another arrival of federal forces to confront urban violence.

Bullrich questioned the “daily, permanent and systematic” presentation of habeas corpus by detainees on trial in defense of their rights in prison. To this end, the Association of Criminal Lawyers of Rosario pointed out to the minister that habeas corpus is a constitutional tool, “the most expeditious remedy that a defendant has to stop any illegality committed by a public authority.”

The lawyers warned in a position published on networks that it is a judge, and not an executive official, who “has the power to accept or reject the request” for a habeas corpus.

Likewise, they replied that “if the minister is aware of illegal acts committed by legal professionals in the role of defense attorney, it is her obligation as a public official to immediately file a criminal complaint for these illegal acts.”

The corporate message frames the “moment of extreme vulnerability” that Rosario is experiencing “due to absolute mismanagement of the criminal policy of the last ten years.” Therefore, “carrying out in just days what has not been done in years generates chaos and disruption in the population.”

That said, the criminal lawyers urged the authorities “to respect the constitutional and international standards of a rule of law.” And they asked: “That prudence and caution in your speech prevail over personal and/or political interests.”
