Through a brief message on social networks, the Minister of Labor, Ivonne Núñez confirmed this Monday, March 4, that the entity will proceed with the payment of profits to former employees of Cervecería Nacional, who since 2008 have claimed that the company must pay for the profits. generated between the years 1990 to 2005.

The minister reported that in the coming days the State Portfolio will issue the payment schedule. The measure will comply with the ruling of the Constitutional Court, of April 2018, as well as what was ordered in the 2023 verification order and in accordance with a resolution order, the latter issued by the Contentious Administrative Court of Guayas, which orders the payment of profits to former Cervecería Nacional workers within a period of fifteen days.

On February 28 of this year, the Contentious Administrative Court issued the payment order to more than 2,600 former workers.

“More than 16 years of struggle were worth it…” Washington Andrade, lawyer for the front of former collaborators, celebrated then.

During the hearing in the Contentious Court, several of the plaintiffs stood outside the facilities, to pressure for the payment of their outstanding amounts.

In June 2023, the Constitutional Court (CC), in a verification order, ruled on requests for clarification and extension of the verification order of January 13, 2021. There it established that the company had to pay the sum of $51, 2 million, taking as a reference that the conversion from sucres to dollars must be carried out at a rate of 25,000 sucres for each dollar, without interest.

This decision modified a previous ruling from the Third Chamber of the Provincial Court of Justice of Guayas that set the amount at $90 million plus interest.

The CC’s ruling left a bitter taste for the former workers, because the amount of profits to be paid was reduced.

By October 2023, the National Brewery reported that the stipulated money had already been allocated to an account of the Ministry of Labor and that it was up to that entity to proceed with the distribution of the resources to former workers.

In total, there are 2,608 former workers and the heirs of the more than 200 who died in these years, who will receive the money.
