The general of Carabineros, Ricardo Yáñez, went to the TC this Friday to request the suspension of the causes of the social outbreak against him.
He General director of Carabineros, Ricardo Yáñez, went to the Constitutional Court (TC) seeking to suspend its formalization in cases of crimes against humanity, within the framework of the social outbreak.
In this sense, the head of Carabineros in the request assures that the 7th Guarantee Court of Santiago “through an irrational and unfair procedureis affecting my dignity and honor, and threatening my personal freedom.”
In addition to this, he explained that through his image, he seeks to “irremediably” damage the institution.
Why did General Ricardo Yáñez go to the Constitutional Court?
Ricardo Yáñez began by arguing that “the investigation is based on the elaboration of an artificial, convoluted criminal type, which contains a alleged command responsibility, which is not an objective element of the criminal offense of illegitimate coercion.”.
Under this context, he said that the police institution in the social outbreak faced a context of “greatest civil violence that has affected our country in decades“. Despite this, he assured that they managed to guarantee security and public order.
In this way, the Carabineros high command explained that it turns to the TC “to guarantee that I am judged in accordance with a fair and rational procedure, without political interventionssince the Public Ministry intends to accuse me of a crime that I have not committed in a commissive or active manner.
Continuing along this line, Yáñez affirmed that he complied with all the requirements of his position, punishing, summing up and denouncing the Prosecutor’s Office. “all acts contrary to institutional discipline that were committed by my subordinates and of which I was aware”. In detail, he assured that there were more than 4,150 administrative summaries.
To close, the Carabineros general, Ricardo Yáñez said: “I did not allow or validate any fact that could be considered an excessive use of force. from my subordinates.”
