Former US President Donald Trump on Tuesday lost his second and final attempt to postpone his trial scheduled for April 15 on criminal charges related to paying money to buy the silence of porn actress Stormy Daniels.

Associate Judge Cynthia Kern quickly rejected the request for a postponement, but a full panel of appeals judges will later consider Trump’s legal action regarding his ban from making comments.

A New York court is trying Trump on 34 charges related to forging commercial documents and paying a sum of money to a porn actress, to prevent his chances in the 2016 presidential elections from being affected.

Kern’s ruling represents another loss for Trump, who has repeatedly tried to postpone the trial, with jury selection scheduled to begin on Monday.

In the court session, the former US President’s lawyers requested that the trial be postponed to give Trump an opportunity to appeal the order banning him from making comments in the case.

Trump’s lawyers say the gag order is an unconstitutional restriction of his free speech rights while he campaigns for president and fights criminal charges.

Last month, Judge Juan Merchan issued an order barring Trump from verbally attacking potential witnesses, court staff and prosecutors after finding that he had made statements in various legal cases that the judge described as “threatening and inflammatory” and “defamatory.”

The judge expanded the order to include his relatives and the relatives of Manhattan District Attorney Alvin Bragg, after Trump attacked Merchan’s daughter online.
