The non-compliance with the periodic presentation of three defendants in the Sinohydro case led to the tightening of measures against them. The deputy judge of the National Court of Justice, Gabriela Mier, accepted the request of the Attorney General, Diana Salazar, and ordered preventive detention and Interpol red notice.

The decision was made on the morning of this Wednesday, March 27, when the hearing to review precautionary measures requested by the Prosecutor’s Office was reinstated.

During the proceedings, the non-compliance with the periodic presentation of the spouses María Auxiliadora Patiño and Xavier Macías Carmigniani and Lui Aisheng, a Chinese citizen, was confirmed. Mier ordered preventive detention and agreed to extend the request for an Interpol red notice to locate and arrest the suspects.

The Prosecutor’s Office also requested a review of precautionary measures for the former Chinese ambassador, Cai Runguo, and citizen Song Dongsheng. For them, Diana Salazar also requested preventive detention, but she was not accepted by the deputy judge.

Gabriela Mier pointed out that these defendants have not been formally notified with the precautionary measures that they must comply with, making it impossible to give way to Salazar’s request until they are notified in legal and due form.

The Prosecutor’s Office withdrew the request for preventive detention against Lenín Moreno

In the hearing that was held on March 20, the Prosecutor’s Office withdrew his request for preventive detention against the former president Lenin Moreno. He is investigated in the Sinohydro case for alleged bribery.

Prosecutor Diana Salazar explained that she was withdrawing her request, since Moreno has complied with the periodic presentations provided in the Embassy of Ecuador in Paraguaycountry where you currently reside.

In June of last year, a judge ordered that the former president appear every month at the Ecuadorian embassy in Paraguayas an alternative measure to the preventive detention requested by the Prosecutor’s Office.

He also established that he appear every four months before the Criminal Chamber of the National Court of Justice in Quito. However, Moreno said that he could not make the trip from Paraguay to Ecuador due to his disability and health problems.
