Four deputies from different parties took up the appeal of the journalist and TV presenter José Antonio Neme: what the law would provide

Anyone who owns a pet knows this perfectly: dogs, cats, birds, rodents and the like often end up becoming authentic members of the family. The fact is that the State, despite the recent efforts on the subject of the parliamentary Intergroup led by Michela Vittoria Brambilla, to date continues not to recognize them as such. It also happens in Chile, where a cutting-edge bill was presented in recent days: that of granting a day’s work or school leave to anyone who is grieving over the death of a loved one. Four deputies promoted the initiative: Daniella Cicardini and Daniel Manouchehri of the Socialist Party, Pamela Jiles of the Humanist Party and Diego Schalper of the National Renewal Party. What pushed them to take this step were the repeated appeals of the popular journalist and TV presenter José Antonio Neme, who after losing his French bulldog invited the world of politics on social media to provide in similar cases “a day to honor the memory of pet and to be able to experience pain intimately.”

Uphill road

Legge Duque (from the name of the four-legged friend in question): this is how Neme immediately named the project. “All workers who have lost their pets deserve the law to recognize their pain and grant them a working day of mourning,” he reiterated in one of his latest Instagram posts. No sooner said than done – one might say – but the process to turn the proposal into law promises to be long and complex. In fact, not only will the text have to be discussed and approved by both the House and the Senate, but it will also have to be accompanied by specific amendments to the Labor Code and the General Education Law. Then, to make it physically feasible, it will be necessary to ensure that people include their pets in a special national register and obtain, if necessary, a death certificate from the veterinarian. «The Duque law rightly recognizes that in every Chilean home the pet is part of the family – explained Cicardini -. And for this reason we are of the opinion that, if today there is space and respect for mourning when a loved one dies, we believe that when a pet dies, those who take care of it have the right to experience this emotional impact and this pain in the same way.”

What does Italian law provide?

As illustrated in this 2019 article (which remains current), even in Italy there is no law that recognizes bereavement leave after the death of a pet (while when a relative dies you can take advantage of three days of paid leave per year ). However, already in 2007 the Supreme Court had affirmed the existence of a similar right for welfare purposes. According to the stoats, in fact, “failure to care for a property animal constitutes the crime of mistreatment”, therefore care constitutes a “serious family and personal reason” by virtue of which it is possible to have access to paid leave.
