The Senate approved the opinion that modifies the Protection Lawwith 69 votes in favor, 49 against and zero abstentions, with the aim of limiting judges so that they can suspend laws, reforms or works challenged through the protection trial.

Given the changes to articles 129 and 148 of the Protection Lawthe opposition – from various voices – pointed out that it is a setback in terms of human rights, in addition to the fact that these changes cannot stop the works of the outgoing federal government.

The changes to articles 129 and 148 of the Protection Lawand 103 and 107 constitutional:

“In the case of amparo proceedings that resolve the unconstitutionality of general norms, in no case will the suspensions issued establish general effects.”

During the positions for and against – up to almost 4 hours to get to the vote -, the president of the Justice Commission and retired minister, Senator Olga Sánchez Cordero, stressed that the modification is not a regression in the guarantees.

“Of course we are not affecting rights and of course we are not making a regression in the guarantees and promotion of rights and we certainly are not violating the principle of constitutionality of the first article.”

For his part, the member of the so-called Plural Group, Germán Martínez, commented that the protection serves to limit power and protect rights.

“Constitutional supremacy is weakened, judges are beaten and a consequence is going to be sought that I hope is not desired, the poor will need to hire a lawyer so that the effects of a sentence that is general are particular and are relative to a single person.” person”.

For his part, Damián Zepeda (PAN) emphasized that the reform is “a poisoned apple”: “What they want is for no one to be able to stop the Government when it is carrying out a work, just as it is (…) the Government doing a work that damages the environment, you are not going to be able to stop it.”

In turn, PRD member Miguel Ángel Mancera said – prior to the vote – that “the Mexican protection will persist and the suspension granted by the federal courts will persist, fortunately for all of us.”

Prior to the vote, Ricardo Morenal (Morena), promoter of the reform, stated that the project is to “avoid the dictatorship of the toga.”

“It seems very serious to me, very serious that the Legislative Branch itself is going to submit, is going to be a cover and rug for the ‘dictatorship of the toga’, because the judges are dictators.”

And, the senator without a party, Claudia Ruiz Massieu, stressed that this measure will “limit the people who defend their rights.”

Senator Emilio Álvarez Icaza asserted that “the Containment Block does not support Morena and its allies curtailing the citizen’s right to protection against abuses of power. With our voice and our vote we say We do not accept the loss of freedoms and rights. And we are going for an Unconstitutionality Action to demolish this new abuse.”
