The magistrate of the Criminal Chamber Vicente Magro, in his capacity as instructor, has agreed to the free dismissal and definitive archive of the case opened last January by the Supreme Court against the senator and former president of the Cabildo of Lanzarote Pedro Manuel Sanginés Gutiérrez, by ruling out that the facts investigated constitute the crime of false denunciation and false testimony. The judge makes the decision after taking the senator’s statement as investigated last Tuesday, April 16.

In a 17-page order, the investigator concludes that there was no intention on the part of the senator to be untruthful in his testimony about alleged irregularities in contracting referring to a specific company and those responsible for it. He adds that the fact that the judicial investigation into said irregularities concluded in an order to close the case cannot automatically imply a demand for criminal responsibilities of the complainant.

“This occurs very frequently in criminal investigation procedures following complaints made that do not have to be false due to the fact that after a long investigation process the proceedings are archived,” the order states.

The archiving decision is added to the one adopted yesterday, Thursday, by the Criminal Chamber of the Supreme Court in relation to another matter also related to the registered Manuel Sanginés, in which alleged crimes of prevarication, fraud against the administration, influence peddling are investigated. , misappropriation and professional disloyalty.

The Chamber agreed not to admit the case against the accused for processing, and to agree to file the proceedings regarding it, with the matter returned to the investigating court number 4 of Arrecife to continue with the investigation of the facts, with respect to the extremes referred to or in relation to the actions of the persons not certified and mentioned in the Reasoned Exposition sent by the judge to the Supreme Court. This case refers to the irregular hiring of a lawyer in public companies in Lanzarote.
