81-year-old man sentenced to prison for defending his property

The Spanish court handed down 7 years in prison for the 81-year-old retired bookseller, Pepe Lomasby finding him guilty of manslaughter for the death of Nelson David Ramireza 35-year-old Honduran migrant who had a total of 45 criminal records and who was shot when he was caught inside the Lomas property with a chainsaw.

The incident occurred during the early hours of August 1, 2021 when Pepe, then 77 years old, woke up around 2:30 a.m. and got up to check the operation of his irrigation system on his farm in Valdelobo, It was then that he saw that someone had entered his home, so he armed himself with his shotgun and shot several times at ‘a conical-shaped lump’ that appeared in his yard, although he never imagined that it was a real person, in addition to mentioning that the intruder was wearing a chainsaw.

Once the authorities removed the body, they identified the deceased as Nelson Davida migrant from Honduras who had 36 records in the National Police and 9 in the Civil Guard.

It was the family of the deceased who raised the accusation in particular, initially requesting a sentence of 25 years in prison, pointing out that Lomas acted treacherously causing the death of the migrant, so the judge determined that the elderly man will have to serve a sentence of 7 and a half years in prison and cover a fine of 236 thousand euros.

During the trial, Lomas doubted that his shooting ended the life of Nelson Davis and points out that possibly someone planted the corpse on his farm and then fled, stating that on past occasions he filed multiple complaints about entry and destruction of his property, which were never attended to by the police.
