The decision of the National Infrastructure Agency (ANI) to revoke the port concession to Grupo Portuario SA has sparked an iinvestigation by the Disciplinary Investigation Chamber. The investigation focuses on the reasons that led the ANI Board of Directors, in an extraordinary session on December 28, 2023, to reverse the prior approval of the port concession. The Attorney General’s Office maintains that false motivation could have been incurred by arguing possible environmental effects without adequate supporting evidence.
In addition, a possible violation of due process is indicated in the processing of the request for modification of the port concession contract, including irregularities in the formation of the board of directors and the omission of its participation in the reconsideration appeal.
With this measure, the Attorney General’s Office seeks to clarify the reported facts, determine whether they constitute disciplinary offenses and evaluate whether those involved acted in accordance with established regulations.
