“The answer (to the Ministry of the Interior – ELTA) indicates that Article 177 of the Code of Criminal Procedure provides exclusively for the prosecutor the right to decide which pre-trial investigation data is confidential and to what extent it is permissible to publish it before the trial in court.

Taking this into account, in this case, a pre-trial investigation in accordance with the specified article of the Criminal Code could be started only if such a decision was taken by the prosecutor, who assessed that the publication of specific data harmed the pre-trial investigation and established other necessary signs of a criminal act,” the prosecutor’s office said in a statement.

As Elena Martinonienė, the head of the Communications Department of the General Prosecutor’s Office, stated to Eltai, the investigation into the possible disclosure of pre-trial investigation information without permission has not been started.

“The pre-trial investigation has not been started,” E. Martinonienė told Eltai.

ELTA reminds that on April 19 G. Nausėda reported that two persons suspected of the attack in Vilnius against the Russian opposition member L. Volkov were detained in Poland. After this news, the head of the country received criticism from some politicians.

Minister of the Interior A. Bilotaitė said that publishing such information is the prerogative of services, not politicians. She also raised questions as to whether G. Nausėda’s statements did not harm the ongoing pre-trial investigation. Reacting to the criticism, G. Nausėda assured that his communication would not harm the research.

Last week, A. Bilotaitė appealed to the General Prosecutor’s Office, asking to assess whether President G. Nausėda, who announced the arrest of possible attackers of Russian opposition member L. Volkov, did not violate the law.

Alexei Navalny’s associate L. Volkov was attacked in Vilnius in March. A large police force responded to the report of a Russian citizen being attacked and injured in Vilnius, Aro and special officers were called. It is considered that the attack may be related to the victim’s political activities.

The police are conducting a preliminary investigation into a minor health disorder.
