Mere disappointment with the performance of a wedding photographer does not give rise to a claim for compensation. The regional court in Cologne stated this in a decision and thereby confirmed a decision of the lower court (ref. 13 S 36/22), as the court announced on Tuesday.
The wedding photographer gave the newlyweds a USB stick with 170 photos from the wedding. The couple was dissatisfied with this: events such as the release of balloons and group photos were completely missing from the motifs.
The bride and groom went to the district court and demanded at least 2,000 euros in compensation: the offer of the picture had caused them disappointment and sadness. The wedding will forever have a negative impact and will be “overshadowed for life” by the argument with the photographer.
The court found that mere disappointment, even for weeks, was not enough. In order to claim compensation for pain and suffering, the offense of bodily harm must be met and the psychological impairment must reach a level of illness, explained a court spokeswoman. After the regional court’s decision, the couple withdrew their appeal. The judgment of the district court is therefore legally binding.
