The judge relied on article 558 paragraphs 1, 2 and 3 of the Comprehensive Organic Criminal Code (COIP) to establish three protection measures:

1 Prohibition of the person prosecuted from attending certain places or meetings.

2. Prohibition of the accused person from approaching the victim, witnesses and certain people, wherever they are.

3. Prohibition of the prosecuted person from carrying out acts of persecution or intimidation of the victim or members of the family nucleus by himself or through third parties.

Francisco Sebastián BA is accused of allegedly offering influence peddling, a crime classified in article 285 of the COIP.

According to the theory of the case presented by the Prosecutor’s Office at the hearing, the complainant was apparently contacted by Francisco Sebastián BA and an alleged advisor to Vice President Abad, who since December 10, 2023 has been the ambassador of Ecuador in Israel.

The idea was to offer Romel P. the position of communications coordinator in the Vice Presidency of the Republic, but they had asked him to give them $2,000 of the salary of $3,200 that he would receive.

Finally they agreed that he should deliver $1,500 and Francisco Sebastián BA would keep $1,700. To ensure the monthly payment, those who offered him the job made Romel P. sign a bill for $30,600, but he had problems covering what was agreed for the months of December 2023 and January 2024.

Being left with little money from his monthly payment, the complainant asked that the first two bills be accumulated so that he could pay them in February 2024, but that could not be because he received notification of his separation from the Vice Presidency of the Republic beforehand. The former public official demanded that the bill of exchange be given to him, but Francisco Sebastián BA did not do so, as he said that this document should be burned.
