The State Defense Council (CDE) filed a legal action accusing a series of irregularities in the awarding of a project.
He State Defense Council (CDE) filed a complaint against those found responsible in Codelco for the crime of tax fraud. The judicial action accuses a series of irregularities that occurred within the company, which would have generated property damage that would amount to $12.8 billion.
The complaint, which was filed in the Seventh Guarantee Court of Santiago, details various irregularities in the award to the company Outotec in 2017where payments without justification are accused, suggest the existence of bribes to mining officials, among other illicit acts.
In detail, through a tender for the maintenance and cleaning of the Chuquicamata Division oven, the aforementioned company prevailed over two other firms that participated. This service had a cost of $8.429.340.874 and a period of four months was established to carry out the work.
The alleged irregularities in Codelco
The judicial action was based on an audit carried out by the Chilean Copper Commission (Cochilco)where it is pointed out that the tender was not totally transparent.
In this way, the report maintains that “the date of receipt of the offers by the process manager was modified without notifying the offerors, which favored the company Outotec, as it allowed it to upload its offer to the portal after the deadline. ”.
In that sense, “multiple situations of criminal relevance were verified, such as contracting the most onerous of the available options, without justified cause; the failure to provide proportional discounts for services not provided by the successful bidder company; the non-imposition of fines for delays and non-compliance in application of the respective contractual clauses, among others.”
Due to the above, the document established that there was property damage of $12.802.921.349 a Codelco.
According to the complaint filed by the CDE, the facts show that “willful conduct which ultimately result in the subscription and execution of “a contract that is inexplicably burdensome and detrimental to the assets of the public company Codelco.”
