Assemblyman Fernando Jaramillo filed a “notitia criminis” with the prosecutor’s office to investigate alleged attempts to destabilize the government of President Daniel Noboa.

Fernando Jaramillo, former assembly member of the group Good people (dissident of Build), and now from the official National Democratic Action (ADN), presented this, June 21, 2024, a “crime data” to the State Attorney General’s Office (FGE) to investigate alleged attempts to destabilize the government of President Daniel Noboa.

The expression “crime data” It is a legal term referring to the alleged commission of a crime, but it does not imply the guilt of the accused, but rather the knowledge of the existence of an infraction and the need to investigate it.

“The Attorney General’s Office should investigate these events and, in accordance with its powers, determine those responsible in order to guarantee peaceful coexistence in the country and prevent the constitutional rule of law from being fraudulently violated,” Jaramillo said.

The parliamentarian based his request to the prosecutor’s office on article 353, paragraph 11 of the Comprehensive Organic Criminal Code (COIP) referring to Treason against the Homeland, which states: “Anyone who commits any of the following acts shall be punished with a prison sentence of seven to ten years in peacetime, and with a prison sentence of ten to thirteen years in armed conflict (…) disseminating news with the intention of instilling panic, discouragement or disorder among the troops or committing any act that may produce similar consequences.”

Jaramillo’s decision comes a day after ADN denounced in the plenary session of the Assembly that the opposition benches to the regime would be trying to declare the mental incapacity of the head of State, but that it was rejected by the legislators of the blocks of the Citizen revolution (RC), Christian Social Party (PSC) and the movement Build.
