In a recent ruling, the Attorney General’s Office has confirmed that the cause of death was the improper use of equipment by a uniformed officer of the Mobile Anti-Riot Squad (ESMAD).

The Attorney General’s Office has imposed a sanction of dismissal and disqualification for 18 years on patrolman Néstor Samuel Pacheco Niñoa member of the Bogotá Metropolitan Police and ESMAD, for having exercised excessive use of force.

The investigation revealed that During the protests on June 21, 2021, patrolman Pacheco Niño exceeded his legal powers and established limits, using lethal ammunition of their equipment to try to control the riots.
