The ‘Special Prosecutor Act on Private First Class Chae’, which was passed in the National Assembly plenary session on the 4th under the leadership of the opposition party including the Democratic Party of Korea, was transferred to the government on the 5th. If the Special Prosecutor Act is transferred to the government, President Yoon Seok-yeol must decide whether to exercise his right to request reconsideration (right to veto) within 15 days, by the 20th of this month.
At around 11:00 AM on this day, the National Assembly transferred the bill on the appointment of a special prosecutor to investigate the obstruction of investigation into the death of a Marine and the concealment of the incident (the Private Chae Special Prosecutor Act) to the government.
The presidential veto can be exercised within 15 days after the bill is transferred to the government. Accordingly, President Yoon must decide whether to exercise it by the 20th of this month. The presidential office announced the veto the day before, saying, “We deplore the shameful trampling of the Constitution in the history of constitutional government,” after the special prosecutor bill for Private First Class Chae passed the plenary session.
However, the government does not plan to hold a special cabinet meeting chaired by Prime Minister Han Duck-soo on the same day to deliberate and vote on the veto motion. There is a high possibility that the agenda will be processed when the cabinet meeting is held on the 9th.
If President Yoon exercises his veto, the National Assembly will proceed with the re-review process. In order for the special prosecutor’s bill to be re-reviewed, more than two-thirds of the members present must vote in favor. In the 22nd National Assembly, the number of seats held by the opposition party is 192, so even if just eight members of the ruling party leave, the veto can be nullified.
