The legal battle between rapper Sleepy (40, Kim Seong-won) and his former agency TS Entertainment has entered a protracted period.
Attorney Kim Bo-hyeon of AK Law Firm, the legal representative of TS Entertainment, recently announced that he would file an appeal in relation to the Seoul High Court’s recent decision to uphold the original court’s decision in favor of the plaintiff in the 280 million won damages lawsuit filed by TS Entertainment against Sleepy.
According to TS Entertainment, this second trial ruling is a result of a lawsuit that sought to prove that the defendant Sleepy was responsible for the termination of TS Entertainment and Sleepy’s exclusive management contract in 2019.
Attorney Kim claimed, “During his exclusive contract with the company, Mr. Sleepy deceived the company and gained illicit profits through years of backlighting, social media advertising, and unauthorized events, causing damage to the company, and during that time, he spread false instigation and false facts through various media outlets.”
He then pointed out that “in this second trial, we have for the first time received a legal ruling that Mr. Sleepy has obtained unfair profits and caused damage to the company over the years.”
However, TS Entertainment’s interpretation is that “the situation in which the initial stage of the lawsuit ended with an exclusive contract termination mediation was not one in which the exclusive contract ended amicably, but rather was terminated due to a breakdown in trust, and the resulting monetary damages were to be sought in a separate lawsuit, and the second trial court for damages misinterpreted the mediation proposal and ruled that ‘there is no monetary damages’ because the situation ended with mediation.
“From our side, this is a judgment that was interpreted incorrectly,” he added. “That is why we decided to file an appeal regarding this part of the lawsuit.”
Attorney Kim also announced, “In the future, we plan to file a criminal complaint and indictment regarding Mr. Sleepy’s illegal profits through backlighting, social media advertising, and unauthorized events, which were first acknowledged in this ruling.”
Previously, TS Entertainment and Sleepy signed a six-year management contract in October 2008. The contract was continuously extended, but Sleepy filed a lawsuit to confirm the invalidity of the exclusive contract in April 2019. As a result, the contract between both parties was terminated.
After that, TS Entertainment filed three major claims against Sleepy: ▲ claim for distribution of entertainment activity profits according to the exclusive contract ▲ claim for settlement of broadcast appearance fees ▲ damages due to termination of the exclusive contract. However, in October 2021, the first trial ruled in favor of Sleepy, and the second trial maintained the same decision.
