Cordero highlighted the initiative of the Judiciary, stressing that this type of measure will improve the current system of appointments of judges in the country, as well as notaries and registrars.
In its main points, the text indicates that the Supreme Court plenary is asking to modify the appointment system, “but maintaining the participation of the three branches of government in the appointment of the positions of ministers and prosecutor of the Supreme Court, and excluding, as soon as possible, any interference from the judicial system in the process of appointing notaries, conservators and archivists.”
Key points of the proposal
The document establishes seven bases for the modification of the system of appointment of judges, among which the following stand out:
- Creation of an autonomous body in charge of non-jurisdictional functions: The way to achieve the separation of these functions must be the creation of one or more autonomous bodies, with legal personality and their own assets, which should be endowed with constitutional autonomy.
- Functional and territorial decentralization of judicial government: The various functions of government should be housed in more than one body, in order to avoid a concentration of powers.
- Specifically, the creation of three macro-regional Councils or Units (northern, central and southern areas of the country) is proposed, which would be in charge of the respective appointment functions in the corresponding territories, and which would exercise their powers in a coordinated manner between themselves and with the National Council or body.
- Appointments: As regards the appointment of the ministers and the judicial prosecutor of the Supreme Court, by majority, it is considered appropriate to maintain the participation of the three branches of government.
- With regard to notaries, conservators and archivists, the conviction has already been expressed to eliminate them from the orbit of the administration of justice, and therefore any participation in the judicial governing body should be excluded with respect to said officials.
