The STF Minister asked the corporation to indicate whether it had removed data from the ex-consultant’s telephone device from December 2022 to January 2023.
The minister of the STF (Federal Supreme Court) Alexandre de Moraes gave 48 hours to the PF (Federal Police) to inform if the former adviser to the former president Jair Bolsonaro (PL) Filipe Martins, arrested since February (understand below)the mobile phone is used from December 30, 2022 to January 9, 2023. The decision is from Wednesday (10.Jul.2024).
To that end, Moraes then requested that the corporation inform if data was removed from the mobile phone of the ex-consultant in the period, 1 day before Bolsonaro’s trip to the USA (30 December 2022) and 1 day after the extremist actions of the 8th . January (January 9, 2023).
The Minister’s decision comes after Tim sent Martins geolocation data. In a document to the STF, the operator confirmed that the former adviser’s telephone device was turned on in Brazil on December 31, 2022, 1 day after the former adviser’s alleged trip with the former president to Orlando, Florida (U.S. ).
Moraes sets a deadline of 5 days after the PF forwards the information so that the defense of Filipe Martins could speak out and for the PGR (Office of the Attorney General) to forward an opinion.

In a petition to Moraes, Bolsonaro’s former advisor allowed his telematics to be broken to prove his stay in Brazil, which contradicts the PF’s argument.

- 16h56m17s – Park Way, administrative region of Brazil, 10 km from the airport of the federal capital;
- 19h56m44s – Jardim Alvorada, Ponta Grossa (PR), 50 km from the capital of Paraná.
The geolocation time of Martins mobile phone matches the time of departure of the flight to Curitiba, say lawyers who took the former consultant on December 31, 2022. Latam confirmed that Filipe Martins boarded for the capital city of Paraná.
Arrest and weak evidence
Bolsonaro’s former adviser was arrested on February 8, 2024 in the operation The Time of Truth and remains in detention. The arrest was approved under the argument of the PF, which Moraes accepted, that Martins was on the run and there was a risk that he would flee the country.
The “flight risk” would be based on the alleged trip to Florida on December 30, 2022, but authorities in Brazil and the United States have never proven this information.

“The name of FILIPE MARTINS also appears on the list of passengers who traveled aboard the presidential plane on 12/30/2022 going to Orlando/USA. However, there were no records of the former adviser’s departure from immigration control, which could indicate that he fled the country to avoid potential criminal liability. Whereas The whereabouts of the person being investigated are currently unknownit is necessary to prescribe precautionary detention as a way to guarantee the application of the criminal law and to prevent the person under investigation from acting deliberately to destroy evidence that can clarify the circumstances of the facts investigated.”
The information given by Filipe Martins to the USA was not confirmed, as noted, – but the arrest was requested anyway.
About “location of the person under investigation” to be “uncertain”the PF ignored photos of Bolsonaro’s former advisor published on an open profile on the internet.
In addition, when Martins was arrested, the PF knew where he was looking: in his girlfriend’s apartment in Ponta Grossa (PR), 117 km from Curitiba – so, he knew where he was. He is now in the Pinhais Medical Penal Complex (PR), the same complex where the prisoners in the Lava Jato operation were held.
