A new Law on road traffic and another, framework – on the road transport system, is proposed by the State Agency “Road Safety”. It has published consultation documents on the two draft laws for public discussion.

This is not the first time this law has been divided. In 2018

Then again, the first was the Road Traffic Act, the second for drivers of motor vehicles, and the third for road vehicles. After their long writing and discussion, they were never accepted by the then government, and then by the parliament.

Now the idea is that there are two laws. The agency’s reasoning says the three laws that govern safety policy are the Road Traffic Act, the Roads Act and the Road Transport Act.

During the period 2014 – 2023, the first was changed 50 times, the second – 23 times, and the third – also 23 times. Frequent amendments are an indication that laws do not primarily regulate all social relations. Changes do not always lead to timely updating of the by-laws. An example of this is the currently effective Rules of Implementation of the Law on Road Traffic, whose legal basis for issuance is the already repealed law.

According to the agency, the large volume of by-laws creates difficulties in their implementation both by the administration and by the participants in the road transport system.

“The proposal for changes in the legislation and the division of the Road Traffic Act into two draft laws aim at clarity and structuring. In the Road Traffic Act, only traffic rules, control and administrative penal provisions should remain. Thus, it will be shorter and understandable for all road users.

The second bill, on the road transport system, is a framework one. Its purpose is to systematize the connections and interactions between these separate elements in the human-road-car system and to clearly define the responsibilities of the institutions in relation to each of them”, explained Malina Krumova, chairwoman of the State Agency “Road Traffic Safety” .

According to her, this law will regulate the registration, the technical condition of the cars, the training of the drivers, and some gaps will be filled, for example, for the service activity.

It will also include the training order for license applicants, the rules for driving schools, the exams. The role of the infrastructure and the responsibility of road owners for traffic safety will also be regulated.

“It is important to clearly and unambiguously define the interaction between the individual systems that affect road traffic trauma,” she says.

The purpose of the two draft laws is to create a permanent, sustainable and comprehensible regulatory framework for road users. It must take into account the traffic situation and allow easy identification of violations.

Another major goal is to protect the life and health of road users, facilitate movement and protect property, reduce road injuries and social and economic losses for society. The expected result is
