Dogs of a breed considered ‘potentially dangerous’ will no longer have that consideration if they pass a behavioural test and those who do not will not only maintain that consideration, but reproduction will be prohibited.

That is one of the proposals included in a draft royal decree which will develop 25 articles of the Law on the Protection of Animal Rights and Welfare, published in the Official State Gazette on March 29, 2023.

Civil liability insurance for all dogs must cover 100,000 euros and there will also be an ‘accidental breeding’ policy for cats.

The text, drafted by the Directorate General for Animal Rights, within the Ministry of Social Rights, Consumption and Agenda 2030, will be presented on July 17 at a technical meeting with the regional governments, which will be able to submit changes to the text until August 31.

The draft was prepared with contributions and improvements from animal protection organisations, veterinary associations and pet breeding professionals.

Social Rights proposes changes to the legal status of certain dogs. For example, modifying the current regulations for those known as “potentially dangerous dogs” so that breeds with this status can no longer be considered dangerous if the animal passes an aptitude test to which it must submit at 12 months of age.

This test will be performed by animal behavior professionals. and must be entered into the dog’s identification register for a record. Dogs that fail the test are considered potentially dangerous and their reproduction will be prohibited.

Within this scope, only dogs registered as “breeders” at the time of their identification may reproduce, something that would also apply to cats.
