The Minister of Labor, Ivonne Núñez, presented a bill to the National Assembly to repeal Chapter III of the Humanitarian Support Law. She did so with an emphatic message: No more emergency contracts!
This was stressed by Núñez, who described the law as an instrument that “violated fundamental rights, such as job stability and equal opportunities.”
The so-called Humanitarian Law was approved to combat the health crisis caused by the Covid-19 pandemic. However, the World Health Organization (WHO) announced the end of the pandemic in May 2023.
The head of the Ministry of Labor urgently calls for the repeal of Articles 16 to 23 of Chapter III of the law. She has also requested that Chapter III of the General Regulations of the law be repealed.
“The emergency contract was created with the aim of ensuring the sustainability of production and sources of income in emergency situations; however, since the health crisis caused by COVID-19 has ended, the essence of this contractual modality loses meaning and is not aligned with the constitutional guarantees to achieve stability and adequate employment for workers,” added Núñez.
Núñez’s proposal establishes two general provisions:
Emerging contracts may not be applied or renewed if they are in force for the first time after the promulgation of this law.
Current emerging contracts will be applicable until their completion and may not be renewed if they are carried out for the first time./La Hora
