When retiring under TELK from January 2024, without receiving another type of pension, do any documents need to be submitted to the National Social Insurance Institution, or is the information from TELK and social services transferred automatically and it is not required to go there as well? According to Art. 71 of the Social Security Code (SSC), persons are entitled to a disability pension when they have completely or partially lost their ability to work permanently or for an extended period of time. A disability pension is granted to persons with 50 and over 50 percent permanently reduced working capacity/type and degree of disability (Article 72 of the Civil Code).

According to Art. 74 of the KSO insured persons acquire the right to a disability pension due to a general illness, if they have lost their ability to work and have acquired the required insurance experience, with a duration according to the age at which they became disabled, and for the blind from birth and for those who were blind before entering work – up to the date of the pension application.

The social disability pension is not related to the work activity of the persons, respectively – with a requirement for completed social security service. The provision of Art. 90a of the Civil Code stipulates that persons who have reached the age of 16, with permanently reduced work capacity/type and degree of disability of more than 71 percent, are entitled to a social disability pension, if no other pension has been granted to them.

The expertise of working ability is carried out by the territorial expert medical commissions (TELK) and by the National Expert Medical Commission (NELC). When TELK/NELK determines a person’s 50 and over 50 percent permanently reduced capacity for work and that person has the necessary insurance experience, acquired up to the date of disability, specified in the provision of Art. 74, para. 1-2 CSR, he is entitled to a disability pension due to a general illness. When a person is determined to have more than 71 percent permanently reduced working capacity, he is entitled to a social disability pension.

You should bear in mind that the right to a disability pension is assessed by the Territorial Division (TA) of the National Insurance Institute for Permanent or Current Address of the applicant. According to Art. 1 of the Ordinance on pensions and insurance service, pensions and supplements to them are granted and paid on the basis of a written application on form UP-1, approved by the manager of the National Insurance Institute, to which the necessary original documents are attached.

The application should be submitted to a territorial division of the National Institute of Social Sciences at the permanent or current address of the applicant, in one of the following ways:

  • in the reception of the territorial division of the National Institute of Social Sciences – in person or through an authorized person;
  • through a licensed postal operator – personally or through an authorized person;
  • electronically – by using an electronic service through the official website of the National Institute of Social Sciences – section “E-services and inquiries” – “Single portal for electronic services of the National Institute of Social Sciences” by selecting service No. 151 from the catalog of services.
  • through the System for secure electronic delivery of the Ministry of e-Government, for the use of which it is necessary for the person to have a registered personal profile, as well as to have a qualified electronic signature or a PIK of the National Revenue Agency or the National Revenue Agency.
