The Yellow Envelope Act was passed in the plenary session of the 21st National Assembly under the leadership of the Democratic Party and other opposition parties, but was ultimately scrapped when President Yoon Seok-yeol exercised his right to demand reconsideration (veto). The Yellow Envelope Act, which was reintroduced by the six opposition parties including the Democratic Party last month after the opening of the 22nd National Assembly, includes provisions that limit the company’s right to claim compensation for damages caused by illegal disputes and prohibit individual union members from being held jointly liable in the event of damages caused by illegal disputes. In addition, a provision was added to Article 2 of the Trade Union Act, which stipulates the nature of workers, stating that “A person who has organized or joined a labor union is presumed to be a worker,” allowing special employment workers and platform workers who are self-employed to form labor unions and engage in disputes against companies, and it is evaluated that the content is stronger than the bill that was scrapped in the 21st National Assembly.

The Democratic Party, which passed the subcommittee meeting of the Environment and Labor Committee just five days after adopting the yellow envelope law as a party platform on the 11th, is aiming to process it within the National Assembly in July. It is also intended to process the agenda coordination committee requested by the ruling party as quickly as possible. A Democratic Party Environment and Labor Committee official said, “We are also considering holding an agenda coordination committee this week, passing it through the Legislation and Judiciary Committee, and processing it within the National Assembly in July,” adding, “There is no reason to delay processing it, as it is a bill that has no constitutional risks and is unlikely to conflict with the Civil Act.”

The agenda coordination committee consists of six members, and if four or more of them agree, the bill can be sent to the plenary session. This agenda coordination committee is expected to consist of three members from the Democratic Party, two from the People Power Party, and one from the Progressive Party, so the Democratic Party is planning to neutralize the agenda coordination committee by obtaining the cooperation of the Progressive Party.

Lee Dong-geun, executive vice chairman of the Federation of Korean Industries, pointed out that “despite the fact that the vast majority of damages issues surrounding illegal industrial action currently stem from the practice of violently occupying workplaces, the revised bill does not contain any content to improve this,” and that “by effectively blocking claims for damages for illegal industrial action, it is encouraging extreme illegal industrial action.”
