Major Israeli importer to be fined NIS 11.6 million

Today, July 17, the Competition Authority announced that food importer and supplier Willifood has been ordered to pay a fine of NIS 11.6 million.

The fine was imposed as part of compromise agreements reached by the agency with a number of suppliers accused of violating the Food Act.

Other signatories to such agreements include Osem, Laiman Shlissel, Shestovich, Engel, Strauss, Tnuva and Sugat. These companies were fined amounts ranging from hundreds of thousands to several million shekels. Later, Sano also joined the agreement, ultimately paying NIS 16 million, four times more than the original agreement stipulated.

The agency says such agreements help avoid lengthy, resource-intensive litigation. Companies find the compromises attractive because formal charges are not brought and the proposed fines are significantly lower than those that could be imposed by the courts.

The antimonopoly agency accuses Willifood of violating provisions of the law concerning illegal interference in the arrangement of goods on store shelves. Another violation is related to the company’s “recommendations” to retail chains on setting consumer prices for its goods.

At the beginning of 2022, the Antitrust Authority began a large-scale review of all existing agreements between major food suppliers and large retailers. The amount of sanctions imposed or under consideration so far is NIS 65 million.
